  • An awareness camp on Mediation as an alternate dispute resolution was organized today on 26.10.2018, in District Court Complex, Bhaderwah by the District Legal Services Authority, Bhaderwah.




BHADERWAH(MOHD MAJID MALIK): An awareness camp on Mediation as an alternate dispute resolution was organized today on 26.10.2018, in District Court Complex Bhaderwah by the District Legal Services Authority, Bhaderwah under the chairmanship of M.K.Sharma, Principal District & Sessions Judge Bhaderwah which was attended by the judicial officers posted at Bhaderwah, members of the Bar Association Bhaderwah and the litigants. 

M.K.Sharma, Chairman District Legal Services Authority, Bhaderwah while speaking on the occasion informed the participants that the process of mediation is a guided negotiation, which parties attempt to negotiate a resolution of their dispute, aided by a mediator. He further emphasized that settling disputes through mediation can save money, ease the court load and more often than not it leaves the parties in better state of mind. 

He counted several benefits of settlement of disputes through ADR mechanism. The judicial officers were impressed upon to inform the litigants about their right to get their disputes settled through ADR in terms of section 89 CPC. The keynote address of Sharma was followed by an open discussion on the topic wherein the judicial officers as well as advocates participated and expressed their views to achieve the objective of section 89 CPC. 

Renu Dogra, Sub Judge, Chairman Tehsil Legal Services Committee, Bhaderwah, while proposing vote of thanks appreciated the positive and pragmatic role of the participants and exhorted the litigants to reap the fruits of this beneficial legislation. It is notable to mention here that in a bid to enable speedy disposal of cases and easing the burden of workload of courts, mediation centres are operated in courts to enable the litigants on appearing for the case to be referred to the mediation center. 

The mediation centre lends the opportunity for the litigants to participate directly, by discussing the case directly with the other party.Further, the court can order refund of the court fee paid earlier in the event of settlement of case through mediation.Lastly, where the mediation fails to resolve the conflict, the case can still proceed for adjudication through the court.
